“Congress should make it clear that Presidents can be indicted for criminal activity, including obstruction of justice,” Sen. Elizabeth Warren writes at Medium in her latest policy release, which comes directly in response to Robert Mueller’s statement this week. “And when I’m President, I’ll appoint Justice Department officials who will reverse flawed policies so no President is shielded from criminal accountability.”
Warren proposes that Congress specifically include the president in Title 18 of the United States Code, where it currently says “[w]hoever commits an offense against the United States or aids, abets, counsels, commands, induces or procures its commission.” Further, “We must also clarify that the President can, in fact, commit the crime of obstruction when he abuses his constitutional authority and be charged for it,” Warren writes.
Beyond what she would call on Congress to do—things Congress could do whoever is in the White House—Warren pledges that, as president, she would choose an attorney general “who does not believe the President is above the law,” and would appoint an assistant attorney general in charge of the Office of Legal Counsel who would overturn the opinion that a sitting president can’t be indicted.
