Mitch McConnell has been packing the courts. He did everything he could to throw sand in the gears of the appointment of Obama nominated judges when he was Senate Minority Leader, and once he became Majority Leader he halted the practice of confirming judges for the duration of the Obama presidency.
During Trump’s presidency, McConnell’s only priorities have been stuffing our judiciary with judges who place partisanship and ideology over the any sort of neutral constitutional principles of rule of law. Democrats should not follow suit.
Next time someone asks Biden or Harris if they are going to “pack” the courts they need to say: “No. Packing the courts is what Mitch McConnell has been engaged in for the past six years, much to the detriment of the credibility of our court system and the principle of equal justice under the law. What we are going to be looking at in our administration is unpacking the courts. Decreasing the influence of justices who were appointed based upon their commitment to party and ideology over the rule of law. And, if it takes restructuring our court system in order to achieve that goal, we will give that serious consideration.
