Lades and gentlemen, members of the bar, the People of this
American republic require your most sound and sagacious advice.
Toward that end I pose a most pressing and urgent, yet entirely
hypothetical question:
If a man, infected with HIV, that virus that causes aids and which
was, until most recently, almost always known to be fatal, a man
entirely possessed of his faculties and reason and who knows he is
infected, having been so advised by the best and most credible of
personal physicians, if such a man so infected
thrusts his penis
whether through violence in that criminal and heinous act of rape
or through an act of mutual passion, perhaps even of love, and in
that process infects his partner, whether victim or lover,
what is his crime?

You all know where I’m going with this, right? You know that now I’m going to drag it out nice and slow, just to prove that the possibilities for this campaign are without end, that it can take forever and a half and there will still remain more than enough angles with which to pursue interest and participation of the average citizen.
You must know too that I am, indeed, an unrivaled and unmitigated whore who will stop at nothing to achieve something that might possibly be called Justice for the more than one quarter million lives already needlessly lost, as well as for those whose lives have yet to be taken by virus.
There is as yet, neither accountability, nor is there statute of limitations, to this most heinous crime of MASS MURDER perpetrated by an indifferent repelican party under the leadership Mitch McConnell and his performing chimpanzee Diaper Don. Donnie Teabags.
There is precedent in the annals of international jurist prudence, as evidenced by legal decisions seen both at Nuremberg and at The Hague. There is no argument that I know of that men like Mitch McConnell may make, either to save their own soles, nor to prevent conviction, on the charge that is leveled against them.
This piece of course is not finished. Yet I simply must eat. And I am so anxious — so very anxious, in that most pressing cause of Justice.

What is his crime?
What was his crime?
HE DIDN’T WEAR A MASK.
We know that the criminalization of the transmission of HIV is in some respects controversial, and as such varies a great deal state by state, with some 11 states and the District of Columbia not even listed as having any criminal penalty at all among the states that are noted on the CDC website, State HIV Laws. Among the other 39 states the laws range from misdemeanor all the way up to Class A felony.
In Washington State for example, it is a Class A felony to infect a child, or vulnerable adult.
What we learn from this is that while not entirely universal, transmission of a contagious and fatal disease has been deemed illegal in certain instances all around the country; we also know that the specific crime may be defined either by intent, or by victim, or by specific action. It may be deemed illegal when there is simply a lack of informed consent.
We also learn that in at least one instance the clear intent of the law has been to protect those most vulnerable among us.
And that is what the law should do, is it not? Protect those most vulnerable?
And that is exactly what conservative republican legislators all across the nation have not done, with regard to covid-19. They have not protected vulnerable adults. On the contrary. While those over 65 account for only 16% of the U.S. population, they account for 80% of the deaths from covid-19; according to the Henry J. Kaiser Family Foundation.
By examining the controversy around the criminalization of HIV transmission we see people grappling with the specter of creating laws that forbid passion, that ban love, and that would create an atmosphere of fear around that most basic of human needs — just to be touched. And yet despite the difficulty, for good or for ill, laws exist.
In comparing the covid-19 pandemic to that of HIV, we see that here too, passion is a significant component to transmission. It is the passion of willful ignorance and obstinate, dogmatic determination not to cajole the citizenry into prophylaxis. The fevered devotion to smaller government leading conservative leaders to deny funding to state and local governments, and that on a partisan basis; forcing local municipalities to keep nonessential businesses open if they are to generate sufficient revenue to maintain public services — and thus forcing larger and larger portions of the population to exposure to covid-19.
With deaths from pandemic surging to over 275,000, with another 50,000 expected by the first of the year, surely this is a passion most heinous and criminal in nature. All those in positions of political leadership who have abandoned their duty, to report the facts and to promote public safety, must be held accountable.
