”Defendant’s willful participation in the Capitol riot, and the subsequent exposure of his ideology, has resulted in his discharge from the U.S. Army Reserves and debarment from NWS Earle.”

A U.S. Army reservist who participated in the Jan. 6 Capitol riot was widely known as a white supremacist and regularly discussed his hatred of Jews while working at a New Jersey-based naval facility, according to new evidence revealed by federal prosecutors late Friday.
The reservist, Timothy Hale-Cusanelli, who worked as a security contractor at Naval Weapons Station Earle and held a secret-level security clearance, was arrested and charged Jan. 15 for allegedly breaching the Capitol. At the time, prosecutors described him as an “avowed white supremacist” and Nazi sympathizer, a determination based in part on evidence provided by a confidential source to the Naval Criminal Investigative Service and a YouTube channel in which Hale-Cusanelli expressed those views.
But Friday’s filing — a bid to keep Hale-Cusanelli in prison while awaiting trial — included newly revealed results of an extensive NCIS investigation following Hale-Cusanelli’s arrest. That investigation included interviews with 44 colleagues at NWS Earle conducted on Jan. 20 and 21.

Of the 44 people interviewed, a majority — 34 — agreed with the description of Hale-Cusanelli as "having extremist or radical views pertaining to the Jewish people, minorities, and women," according to the court documents.

The Capitol rioter's lawyer argued that his client should not be detained pending trial. He told the court that Hale-Cusanelli is not charged with a crime of violence and is not a Nazi sympathizer, according to the court documents.

Prosecutors dismissed these claims, citing photographic evidence of Hale-Cusanelli sporting a Hitler mustache, numerous racist photos saved on his phone, and a now-deleted YouTube channel of his in which he expressed hateful views.
“If he is released pending trial, he will have nowhere to go and nothing to do but look for “the adrenaline, the rush, the purpose” that he found from squaring off against Capitol Police officers and storming the Capitol building on January 6, 2021.”

- A Navy Seaman recalled Hale-Cusanelli saying that if he were a Nazi, "he would kill all the Jews and eat them for breakfast, lunch, and dinner, and he wouldn't need to season them because the salt from their tears would make it flavorful enough."
- Another Navy Petty Officer stated that Hale-Cusanelli referred to black people as "sh*t skinned minorities."
- A supervisor told NCIS agents she had to reprimand Hale-Cusanelli for wearing a "Hitler mustache" to work.
“If nothing else, the events of January 6, 2021, exposed the size and determination of right-wing fringe groups in the United States, and their willingness to place themselves and others in danger to further their political ideology. This threat is, unfortunately, still a reality.”

In his first appearance in court via videoconference in Trenton federal court, assistant U.S. Attorney Sammi Malek said Timothy Hale-Cusanelli, 30, of Colts Neck, told agents that he entered the Capitol as part of the crowd to halt the election results being certified. He told them he thought there was a “strong chance the president would accompany the crowd,” Malek said.

Hale-Cusanelli, who is enlisted in the United States Army Reserves, and also works as a contractor at Naval Weapons Station Earle in Colts Neck where he maintains a “secret” security clearance, was charged with unlawfully entering restricted grounds, obstructing a law enforcement officer, violent entry and disorderly conduct in a Capitol building, demonstrating in a Capitol building and obstructing government business.
Hale-Cusanelli came onto law enforcement’s radar after he allegedly told a confidential informant that he drove to Washington, D.C. and entered the Capitol on Jan. 6, while also showing the informant video of him “making harassing and derogatory statements toward Capitol Police officers both inside and outside the Capitol building,” according to the criminal complaint.

United States’ Opposition to Defendant’s Motion for Conditional Release
Defendant poses a substantial risk of danger to the community if he is released. Having sworn a duty to uphold and protect the Constitution against all enemies, foreign or domestic, Defendant literally abandoned his post to participate in an insurrection with the stated intent of obstructing the certification of the Electoral College vote. Defendant has not only embraced a dangerous, White Supremacist ideology, he has preached it on YouTube in hopes of luring more “patriots” to his cause. It is unclear how long Defendant has harbored a fantasy of participating in another Civil War—one in which “the fucking good old boys in the Midwest, Texas, and Arkansas” will provide American society with a “clear bill of health.” It is clear, however, that he is no longer fantasizing – he now sees himself ready to refresh the tree of liberty with “the blood of patriots and tyrants.
