Each term, the Supreme Court rules on cases that have the potential to completely change the trajectory of millions of lives, like the Dobbs v. Jackson Women’s Health Organization decision that resulted in the overturn of Roe v. Wade.

Such immense responsibility should come with accountability processes if things go wrong, but the Supreme Court has no formal code of ethics. That’s right—the most powerful court in the country is bound by absolutely zero ethical standards, unlike lower courts.

There are a number of avenues we can pursue to make this right, including passing legislation to establish a code of ethics for the Supreme Court. Congress can also add four seats to the court and restore the balance of power by passing the Judiciary Act of 2021, reversing Trump’s extremist takeover of the bench.

In recent months, we’ve seen several examples of gross overreach, abuse of power, and ethical misconduct from Supreme Court justices and their inner circles.

Ginni Thomas actively pushed for the 2020 presidential election results to be overturned, and Justice Clarence Thomas has issued rulings on cases involving the insurrection. If that wasn’t enough, Justice Samuel Alito is reported to have leaked the outcome of the major birth control decision Burwell v. Hobby Lobby to top anti-abortion activists before the opinion was released to the public.

It is impossible to place our trust in a rigged, unethical court with justices who conduct themselves with jaw-dropping impropriety. It is unthinkable that the justices who are denying us our fundamental human rights and bodily autonomy are the very same people purportedly engaged in decision leaks, dark money, and more. In addition to pushing for ethics reform, Congress must restore integrity and balance to the bench by expanding the Supreme Court.

Restore abortion access. Expand the Supreme Court.
