Domestic Terrorist Lucas Denney plead guilty yesterday to one felony count of “assaulting, resisting, or impeding officers while using a dangerous weapon,” a crime punishable by up to 20 years in prison and a $250,000 fine.

Lucas Denney appeared for the second time in a week before U.S. District Judge Randolph Moss to enter his plea. He’d upended an earlier hearing on Monday meant to be about dismissing the criminal complaint against him when one of his attorneys said he intended to plead guilty instead.

Moss was skeptical about that plan, and reset the hearing for Thursday to give him time to research the issue and for lawyers for both sides to come up with estimated sentencing guidelines. On Wednesday, assistant U.S. attorney Jennifer Rozzoni filed a brief estimating Denney could face a recommended sentence of 57-71 months in prison if he pleaded guilty to assaulting police on Jan. 6. Shipley estimated it lower, at 41-51 months.
On Thursday, after repeatedly asking Denney if he understood what he was doing, Moss accepted his guilty plea. Because the charge is a violent felony, Moss ordered Denney to remain in custody while he awaits sentencing, which was set for June 9.

U.S. Magistrate Judge Zia Faruqui delivered the stern rebuke to federal prosecutors at a hearing for a Texas man who the judge said was “lost” in the court system after being arrested in December and accused of assaulting police officers during the storming of the Capitol.
“You have been lost for months,” Faruqui told Lucas Denney of Mansfield, Texas, during a hearing in a Washington courtroom. “There’s no excuse to treat a human being like that. … There is no circumstance under which any person should be forgotten.”
Faruqui said the mammoth nature of the federal investigation, which has led to charges against more than 750 people, was no justification for Denney’s languishing in custody.

Denney bounced on his feet and rolled his neck as he listened to the judge read the charge and ask whether he was aware that by pleading guilty he was waiving his right to a trial and that the government could still bring more serious charges against him.

Moss said Monday he was concerned that Denney might be making a hasty decision that could still result in years behind bars, and delayed Denney’s arraignment until the prosecution and defense could present sentencing recommendations. Denney’s attorneys suggested 41 to 51 months in prison. Prosecutors asked for 57 to 71 months. The charge carries a maximum sentence of 20 years in prison and a fine of up to $250,000. Sentencing is scheduled for June 9.
Denney’s lawyer William L. Shipley wasn’t even in the courtroom... He was literally phoning it in from Hawaii!

The hearing was temporarily derailed when it appeared that Denney might not have fully understood the consequences of pleading guilty to an indictment, and not pursuant to a plea deal.
“We don’t know whether the government will bring additional charges against you,” U.S. District Judge Randolph Moss said to Denney after Assistant U.S. Attorney Jennifer Rozzoni said that the government hadn’t yet decided if it would do so.

“I want to make sure Mr. Denney understands he may still face significant charges relating to the events on or surrounding Jan. 6, and those could be significant felony charges or misdemeanor charges, or both,” said Moss, a Barack Obama appointee, after being interrupted by defense attorney William Shipley, who told Moss that he had discussed Denney’s rights with him.
I really don’t see what Denney has to gain here… He can’t say he wasn’t warned!

Lucas Denney, 44, of Mansfield, Tex., created a militia in Texas he called “Patriot Boys of North Texas,” which he said was aligned with the Proud Boys, a far-right group with a history of violence, court records show. Denney was captured on multiple videos and photographs battling with police on the West Terrace of the Capitol, pushing with a mob inside the Capitol, and then as part of a large crowd that grabbed individual officers who were fighting the rioters, including D.C. police officer Michael Fanone.
Photographs show Denney swinging his fist and grabbing at Fanone, who was dragged into the crowd, shocked with a Taser and suffered a heart attack. Denney is also seen picking up a long plastic pipe, swinging it at another officer earlier in the riot, then hurling it in to the police lines. He admitted Thursday to that one act, and that the PVC pipe qualified as a dangerous weapon.
Court records show Denney was arrested Dec. 13 in Kinney County, Tex., near the Mexican border, on eight counts of conspiracy to obstruct an official proceeding, assaulting police with a deadly weapon, engaging in physical violence and other charges. He made his first court appearance the next day. Three days later, he was ordered to be held in jail until trial and was to be moved to D.C. for further proceedings.
