On Friday, February 25, 2022, at approximately 11:35 p.m., deputies from the St. Mary’s County Sheriff’s Office responded to Action Lounge and Billiards in Leonardtown for a reported threats call.
Police arrived at the scene and were speaking with the caller, when an adult male, later identified as John Daniel Andries, 35, of Piney Point, was removed from the establishment by security.
The deputies advised Andries that he would not be able to re-enter the establishment and would have to leave, Andries then attempted to open the door back up and repeatedly stated that he wanted to go back inside and was pulling on the door handle. Police then told Andries that he would be able to leave on his own or he would be coming with them, Andries then poked Sgt. Fleenor in the chest, and was placed in handcuffs. Andries then refused to allow police to take him to their patrol vehicle, and sat down on the ground, forcing them to drag him to the patrol vehicle, once at the patrol vehicle, Andries refused to sit in the vehicle and repeatedly kicked Sgt. Fleenor as they attempted to place his legs inside the vehicle.
He was charged with two counts of felony assault (one on a cop), two counts of misdemeanor disorderly conduct and one count of resisting arrest…

[Andries’] attorney, federal public defender Maria Jacob, told [U.S. District Judge Rudolph] Contreras she thought there were conditions of release short of detention that could ensure Andries’ and the public’s safety. Jacob told Contreras that Andries had been receiving counseling and had been “overwhelmed” by the publicity in the Jan. 6 cases. Andries himself apologized, telling the judge he was ashamed and his behavior was “abhorrent.”
Contreras decided to keep Andries out of jail and ordered him onto GPS monitoring and a curfew from 10 p.m. to 6 a.m. He also ordered Andries not to use alcohol and to undergo regular substance testing.

Andries, who enlisted in the Marine Corps in 2004, joined Marine Helicopter Squadron One in 2006, officials said. His duties included aircraft maintenance as a presidential helicopter crew chief.
The squadron, also known as HMX-1, oversees presidential travel aircraft. The helicopter is known as Marine One when the president is aboard. The squadron’s other role is testing and evaluating helicopters.
But Andries stands apart for his duties in Marine Helicopter Squadron One, a highly selective post even for enlisted crew members. “An assignment with HMX-1 is one of high visibility and great responsibility,” read one Marine Corps bulletin that sought pilots.
Andries left the Marine Corps as a lance corporal in November 2009 with no combat deployments, according to his service record. His assignment within the squadron covered the George W. Bush and Obama administrations.

John Daniel Andries, 35, of Piney Point, Maryland, was arrested last month on two felony counts of knowingly entering or remaining in any restricted building or grounds without lawful authority, and violent entry and disorderly conduct on Capitol grounds, according to his criminal complaint.

The FBI agent who compiled the complaint said he went on to identify Andries in multiple videos and surveillance footage from the riot, including one clip in which he was identified at the front of a crowd that pushed down barriers outside the Capitol.

A deputy sheriff in the St. Mary County Sheriff's Office helped the FBI identify Andries, according to the complaint. The deputy sheriff had interviewed Andries at his home on January 11 in connection to an unrelated police report and said that the man in the Capitol-riot videos "looks like him" and that he had "distinct shaggy hair and a beard," according to the complaint.
