In a letter to state officials posted on video-sharing platform Rumble, Harry Wait – the president of a group called Honest, Open and Transparent Government – said he went online this week and successfully ordered absentee ballots in the names of Wisconsin State Assembly Speaker Robin Vos, Racine Mayor Cory Mason and other voters to show the “ease of harvesting election ballots online.”

Submitting false information to obtain an absentee ballot and making false statements to election officials are crimes under Wisconsin law. Democrats on the Wisconsin Elections Commission called for the panel to make a criminal referral during an emergency meeting Thursday night.

In a statement earlier Thursday, the commission said there was “no indication of any vulnerability” in MyVote, the state’s online election portal. Its members agreed to notify voters who may have been affected by the intrusion, and the commission issued guidance to local election clerks to watch for potential fraud in absentee ballot requests.

The state Department of Justice is launching an investigation into a scheme to commit election crimes by a group of Wisconsin residents who believe former President Donald Trump did not lose the 2020 election and fraudulently requested absentee ballots to prove voter fraud exists.
The probe comes a day after Racine County Sheriff Christopher Schmaling revealed he was aware of the plot but blamed state elections officials for the violations instead of arresting the offenders who had confessed to the crimes.

It's unclear whether the DOJ review will examine Schmaling's response to learning of the plot that he initially publicized as an effort to show deficiencies in the state's voting system instead of violations of election law.
"DOJ is aware of reports of ballots being requested in Racine County for registered voters without their permission. DOJ has been in contact with (Racine County) DA (Patricia) Hanson and will be investigating this matter. As this is an ongoing matter, DOJ will not be providing further comment at this time," DOJ spokeswoman Gillian Drummond said in a statement.

Requesting a ballot through MyVote generates an email to the voter’s municipal clerk. The clerk can check with the voter to ensure the request is legitimate and makes the final call on whether to send a ballot.
Barry Burden, the director of the Elections Research Center at the University of Wisconsin-Madison, said someone who engaged in such activities would likely be caught because the fraudulent request would be discovered when the real voter requested an absentee ballot or showed up the polls. Burden said he knows of no schemes similar to Wait’s.
He added that while elections systems aren’t perfect, there have been no signs of widespread fraud after numerous reviews of recent elections.
The system works just fine… By design it catches fraud when ballots are cast.
