'Judicial coup': MAGA allies melt down over latest 'insane' Trump court loss

Allies and advisers of President Donald Trump melted down late Friday after a federal court ruled his administration must allow six transgender people to have their preferred gender reflected on their passports.

...Trump adviser Stephen Miller wrote on X, "Judicial coup" in response to the ruling.

MAGA attorney Mike Davis, meanwhile, wrote on X: "Insane. Great work, John Roberts."

I wonder why he’s blaming Roberts…

Reading the various articles, it seems that this preliminary injunction only applies to the plaintiffs. BUT

….Nowlin-Sohl said it plans to file a motion requesting the ruling be applied to all transgender and nonbinary Americans.

I hadn’t realized it’s been 30 years that one can choose gender on a passport. That’s helpful, I think, since it’s a precedent that has lasted over time.

BOSTON (AP) — A federal judge on Friday blocked the Trump administration from enacting a policy that bans the use of “X” marker used by many nonbinary people on passports as well as the changing of gender markers.

...U.S. District Judge Julia Kobick, who was appointed by President Joe Biden, sided with the American Civil Liberties Union’s motion for a preliminary injunction, which stays the action while the lawsuit plays out.

Judge Blocks Trump’s Anti-Trans Passport Policy

A federal judge on Friday blocked the Trump administration from enforcing its policy barring trans people from updating the sex marker on their passports.

U.S. District Judge Julia E. Kobick in Boston sided the with American Civil Liberties Union’s push for a preliminary injunction while the lawsuit continues.

“The Executive Order and the Passport Policy on their face classify passport applicants on the basis of sex and thus must be reviewed under intermediate judicial scrutiny,” Kobick wrote in the injunction. “That standard requires the government to demonstrate that its actions are substantially related to an important governmental interest. The government has failed to meet this standard.”

...“The plaintiffs have also demonstrated a likelihood of success on their separate argument that,under any standard of review, the Executive Order and Passport Policy are based on irrational prejudice toward transgender Americans and therefore offend our Nation’s constitutional commitment to equal protection for all Americans

...The judge also found that the administration’s decision to block passport gender marker changes for transgender people was rooted in anti-transgender animus, rendering the policy likely unconstitutional under any level of judicial scrutiny….The judge also ruled that the passport ban was arbitrary and capricious, failing to meet the standards required by the Administrative Procedures Act and the Paperwork Reduction Act.
