In my time as an attorney I have seen snarky responses to demand letters with hollow threats to sue. They are unusual as lawyers write such things aware they could end up before a judge or jury someday and flippancy often does not play well. However, Olivia Troye’s response to Kash Patel’s threat to sue her reflects a new level of “go piss into the wind” responses.
Oliva Troye is a former Trump Administration official in positions related to Homeland Security and Intelligence. She worked with Kash Patel, Trump’s choice to lead the FBI. She has been highly critical of that choice describing Patel as willing to lie about intelligence operations and accusing him of putting the lives at Navy Seals at risk during his time with the Trump Administration.
Patel’s attorneys sent her a cease and desist letter threatening to sue her unless she retracted her claims within five days. Below is a link to a BlueSky post from Troye’s lawyers responding. It is a classic and must read. Very short, but worthwhile. I have dubbed it “The Holy Grail” response.

So far the snark level of the letter is merely moderate. The fruit tree with un-thriving fruit metaphor is fun as is the lawyer-to-lawyer reminder that I’m seeking to sanction your frivolous ass in two other cases. But it is page 2 of the 2 pages that truly moves the snark to unusual levels in legal correspondence.
Well, I think that’s a fairly clear, “no.”
