Admittedly, Michael Newdow was not the poster child for filing this case, but, as an atheist, I'd like to see the First Amendment get a definite ruling to protect freedom from religion, or else see if the sentiment that more Americans would elect a gay than an atheist president really has legs all the way to SCOTUS.
The "no legal standing" vote, given that only three of the eight participating justices wrote a sidebar saying the Pledge "under God" does not violate the Constitution, shows a high degree of dodgeball.
