The Minnesota Supreme Court has ruled in favor of Al Franken. Details are still emerging.
Update: No surprise, decision was 5-0.
Update II: Decision here (PDF).
Update III: From the decision:
For all of the foregoing reasons, we affirm the decision of the trial court that Al Franken received the highest number of votes legally cast and is entitled under Minn. Stat. § 204C.40 (2008) to receive the certificate of election as United States Senator from the State of Minnesota.
That seems to fall short of ordering Pawlenty to issue the certificate. On the other hand, Pawlenty seems ready to wash his hands of this and sign the damn thing, though he'd clearly rather be ordered to do so to appease the wingnut base he'll need for his 2012 presidential run.
Update IV: from the comments:
Breaking: Bill O'Reilly's mind
Shephard Smith may want to duck.
Update V: Pawlenty affirming he'll sign certification papers, expecting the Minnesota Supreme Court to offer the final word on the matter:
If the court indicates that certificate should be signed, I'll sign it. I won't defy an order of the Minnesota Supreme Court.
