The 4th Circuit Court of Appeals has overuled a trial court ruling that Jose Padilla, a U.S. citizen arrested unarmed in the Chicago O'Hare airport may be lawfully detained without a trial solely on the say so of the President.

His sole recourse now is the U.S Supreme Court. Padilla had won a prior appeal in the 2nd Circuit, which was overturned on venue and jurisdiction grounds since the U.S. moved his place of detention to South Carolina.
