Rick Perry Continues Cover Up; Calls Executed Innocent Man "a monster"; Todd's Mother Responds

Rick Perry today vigorously defended his cover up of the execution of an innocent person in Texas by calling Todd Willingham a "monster". Eugenia Willingham, Todd's mother, responded to Perry's statement by telephone on tonight's CNN AC360, saying that Todd loved his kids and that Todd told her his trial was "a big joke" in part because his own defense lawyer thought he was guilty.

Kay Bailey Hutchison said today that Rick Perry's actions and cover up has given "liberals" a valid issue to criticize the death penalty.

Dr. Craig Beyler was quoted on CNN tonight saying that Rick Perry's new appointees to the Texas Forensic Science Commission should resign to restore integrity to the process. Beyler also said Perry is using his political clout to protect himself.

According to an article in today's Houston Chronicle, Texas Governor Rick Perry is refusing to release documents that could show whether or not he considered or even read the information sent to him on the day of the execution of Todd Willingham informing him that there was new evidence casting doubt on Willingham's guilt and raising the question of whether Texas was about to execute an innocent man.

I had been planning with other members of Texas Moratorium Network to attend the meeting of the Texas Forensic Science Commission on Friday and hold a demonstration to Shout it from the Rooftops that Todd Willingham was innocent. Now, Texas Governor Rick Perry has canceled the meeting and replaced the Commission's chair and some other members.

Call the Governor's office to STRONGLY protest his cancellation of the meeting and his replacement of the chair of the commission.

ABC News' Nightline will be airing a story tonight, Sept 17, by reporter Terry Moran on the case of Cameron Todd Willingham. Terry Moran wrote on Twitter: "Tonight on Nightline: My report on the death penalty case of Cameron Todd Willingham.Did Texas put an innocent man to death? Many believe so."

Sign a petition to Governor Rick Perry and the State of Texas to acknowledge that the fire in the Cameron Todd Willingham case was not arson, therefore no crime was committed and on February 17, 2004, Texas executed an innocent man.

The Texas House of Representatives today passed House Bill 2267, "The Kenneth Foster, Jr Act". Sponsored by Rep. Terri Hodge (D – Dallas), the bill would eliminate the death penalty as a sentencing option under the controversial Texas Law of Parties. It would also require separate trials of co-defendants in capital cases. The bill now goes to the Senate for consideration.

We have a good chance to win this and we deserve to win because we have all used social media tools very effectively to jointly mobilize against the Texas death penalty.

The Texas House Committee on Judiciary and Civil Jurisprudence will hear public testimony in Austin on Monday, April 27, on HR 480 by Rep Lon Burnam, regarding whether to begin the impeachment of Sharon Keller, presiding Judge of the Texas Court of Criminal Appeals. Please go to the Capitol on Monday afternoon and sign a Witness Affirmation form in support of impeaching Keller. The hearing is in room E2.010. It will start after adjournment of the House, probably around 1 PM.

On June 2, 2009, the 200th execution under Texas Governor Rick Perry is scheduled to take place. Since he became governor of Texas in December 2000, Perry has allowed more executions to proceed than any other governor in U.S. history.

Terry Hankins is scheduled to be the 200th person executed under Rick Perry. If he or anyone scheduled before him receives a stay of execution, then the 200th person will be the next person on the list.

The Texas anti-death penalty community asks people around the world to focus your attention on Texas and join us in protesting the 200th execution carried out under Rick Perry. Altogether, Texas has executed 436 people since 1982, including 152 under former Texas Governor George W. Bush. One of the people executed under Rick Perry was Todd Willingham, who was probably innocent.

The Texas Legislature is currently considering HB 2267 and HB 304, which would both prohibit the state from imposing the death penalty on people convicted under the Law of Parties.

The Law of Parties allows people who "should have anticipated" a murder to receive the death penalty for the actions of another person. A person sentenced to death under the Law of Parties has not killed anyone.

In 2007, I was one of the many people and several groups who filed a judicial complaint against Sharon Keller of the Texas Court of Criminal Appeals after she refused to accept an appeal 20 minutes after 5pm on the day of a person's execution. The complaint I filed was co-signed by about 1,900 people. I waited, somewhat impatiently, 15 months until the State Commission on Judicial Conduct finally charged Keller with misconduct last week. Last December, I dropped by State Rep. Lon Burnam's office at the Texas capitol with a copy of a blog post I had written on Burnt Orange Report entitled "Legislature Should Remove Sharon Keller from the Texas Court of Criminal Appeals" and urged his aide to ask Burnam to file an impeachment resolution. He filed the impeachment resolution last week and it has been referred to the House Judiciary Committee. Now, I believe Keller should be suspended from office pending the outcome of her upcoming public trial.
