NOTE: The previous title to this post was, “Palmer Report is wrong about yesterday’s Flynn filing” but that now appears to be, itself, wrong. I’ll leave the original content, and the post up, because it’s generating interesting discussion. Please see the update, below, for more information.
There’s a post up on the rec list, Mueller’s not done?, which is sourced from the Palmer Report, claiming that Mueller’s team released a filing yesterday in court. I have not seen any information anywhere to back up that assertion. Instead, both Doc Maddow and Lawfare have reported that it was Judge Emmit Sullivan who unilaterally released the pre-sentencing memo and other documents.
This may seem like a small point but it’s worth pointing out in light of how this information is being digested. To wit: that Mueller is still working behind the scenes. I do not believe that is the case. It appears that this was the judge’s decision only. (And a fantastic one, at that.)
Judge Sullivan also ordered that the government release audio of that voicemail and a version of Mueller’s report with all Flynn information unredacted no later than May 31. The documents can be accessed here.

The government represents that there no longer exists a compelling government interest to seal certain information in those records.
