Kitchen Table Kibitzing is a community series for those who wish to share part of the evening around a virtual kitchen table with kossacks who aren’t throwing pies at one another. Newcomers may notice that many who post diaries and comments in this series already know one another to some degree, but we welcome guests at our kitchen table, and hope to make some new friends as well.
Update on the mystery driveway. The driveway is located at the bottom of our property off an old county road. The driveway appears to lead to a fire road that traverses ours and others’ property. We’ve been curious about this driveway and the couple cars and shipping container located a few hundred feet up the driveway. We were never sure how much of the area was ours. But fairly confident the driveway started on our property.
A couple days ago ...6 months after close of escrow… we received an email from the attorney of the previous owner. It was in regards to an easement thru our driveway for the owner of the neighboring property to access his land. The land is pretty much unbuildable. But the cars and container are on his property ...barely.
The lawyer is wrote that during the purchase some paperwork had been done “out of order.” And that it was important that we have a clear understanding the easement. He continued that it was his understanding “that this easement was made known to you and remembrance when you purchased the lot and that there is no dispute concerning your intent to honor it.”
Then he wants us to go to his office to wet sign the paperwork ...his office is 2 hours away… one direction.
Being the curious one… I decided to search the owner of the neighboring land ...sorta want to know who would be going thru our property. He lives just around the corner from our old home. Wasn’t able to find any social media presence. But did find a lawsuit filed against him. Although unable to read the filings ...the dates filed are listed. Looks like it was filed 7 months before we bought our house. Likely ran up to and after our close of escrow.
And guess who the plaintiff was… the previous owner of our house.
If you ever have sold or bought a house you know disclosures are sorta a big thing. A dispute with a neighbor would maybe be something that should be disclosed.
Ain’t driving 2 hours nor signing anything until we get more info.
