This is a very quick note to give a heads up to the Daily Kos community about an emerging issue identified by NRDC Attorney John Walke concerning the Senate KXL bill.
On behalf of the coal industry, United States Senators Pat Toomey (R-PA) and Bob Casey (D-PA) are advocating a damaging rider for the Senate KXL bil which Attorney Walke outlines in a blogpost from yesterday:

Toomey and Casey are advocating that coal waste-fired power plants be exempted from EPA requirement recently upheld on appeal. The coal industry seeks to exempt itself from emission limitations addressing NOX, SO2 and acid gas emission in
EPA's Cross State air pollution rule and the Mercury & Air Toxics air pollution rule.
This is a serious issue and serious threat and, if enacted, would punch a big whole in the Clean Act Act for Pennsylvania coal-waste-burning power plant facilities.
