Sodomy and The Founding Fathers

You really can't make this stuff up:

Supreme Court Justice Antonin Scalia ridiculed his court's recent ruling legalizing gay sex, telling an audience of conservative activists Thursday that the ruling ignores the Constitution in favor of a modern, liberal sensibility.
The ruling, Scalia said, "held to be a constitutional right what had been a criminal offense at the time of the founding and for nearly 200 years thereafter."

Well, Atrios points out, and I think any of you can see where he's coming from, that there were lots of things that were considered legal at the time of the writing of the Constitution that are most certainly, and definitely shouldn't be, considered legal now. Like, oh say, SLAVERY? Not to mention that at that time, WOMEN COULDN'T LEGALLY VOTE! Yeah, Scalia, your argument holds alot of water. Really.

Scalia is a hero of conservatives who favor a strict adherence to the actual text of the Constitution.

Great. Problem is, you see, that the constitution doesn't, to my knowlege, say anything about sodomy being illegal or wrong. Nor should it. But that's not to say you're incorrect, Mr. Scalia - sodomy definitely was illegal in the 1700s. Good for you.
