If Nevada goes Biden and has the 270 electoral votes required then it might put all of Trump’s electoral lawsuits at risk.
IAMNAL but …
This “irreducible constitutional minimum” of standing has three elements: (1) the plaintiff has suffered a concrete injury; (2) that injury is fairly traceable to actions of the defendant; and (3) it must be likely—not merely speculative—that the injury will be redressed by a favorable decision.
If Biden wins regardless of what happens in PA or GA then Trump suffers no harm from the counting of ballots in those states. He is also not likely to be favorably redressed by any action the Court might order in those states.
Another way to look at this might be that the case is “moot”. The Constitution only gives the Federal courts jurisdiction over actual ongoing cases or controversies. If BIden wins the election regardless of the ruling then there is no controversy.
Others might be able to sue but I don’t see how Trump could.
Again, I’m not a lawyer and we have yet to see if the current SC is interested in the Constitution, but it seems that all his cases could get tossed.
If I’ve got this wrong, please correct me.
