Today, the a Florida judge threw out the confession of John Evander Couey because the police violated his civil rights. I am irate. More below the fold.
The law is very clear, you ask for a lawyer and are not given one, anything you say after that is excluded. Why is this so hard for the police to understand? I am sure the media will use this as another rant against the Defense Bar, but come on? The laws are so slanted in favor of the police and prosecution, why can't they just follow the simple laws that are set up. For once I want the media or legislators or anyone to put the blame where it squarely belongs - on the police conducting the investigation.
Why don't we get rid of the prosecutors that convict innocent people, rather than find the person who actually committed the crime. Instead, they get promoted and the incentive for the conviction, rather than the truth is again rewarded. Every single time the ire goes torwards the criminal justice system. If this guy is not convicted because of this failure, I hope there is finally some ire directed where it belongs. I am not holding my breath.
