The buzz today is that Sam Alito may, or may not, be the next nominee to the Court. The sub-buzz is that he has been nicknamed "Scalito" because he was so like Scalia.
But the Volokh conspiracy says that Alito is not really a miniature Scalia.
How did he get the nickname?
The Buck Stops Here notes that this seems like one of those things that never really was a nick name - rather it was something that reporters make up in order to make a story sound interesting. There's even a comment there by someone who claims to be a reporter and to have originated the nickname. And here is his website.
So, what's the big deal, you ask? Well, everyone from Drudge to Chris Matthews is reporting that the "Scalito" nickname is "ethnically insensitive" and was created by the DNC. Hell, you'd think we'd just launched a new episode of the Sopranos or something!
The good news is, if this is all they got coming into the ring, them I'm not impressed.
