Olberman said tonite that to the average citizen the failure of Ailto to recuse himself was serious and looked like a throat cutter. That it not only brought up questions as to whether Ailto should serve on Scotus but whether he should serve on any court.
Law Prof. Turley said he thought it was serious but not fatal. However he thought it was definitely a shot below the water line. Turley also went into the issue of impropriety and avoiding even the appearance of impropriety, saying Alito failed to error on the side of recusal.
Pat Buchanan followed and felt it was a shot below the waterline also but that the Dems would not filibuster over it. Turley added that Senators vote all the time and have conflicts; a real red herring as Senators don't have to recuse themselves.
Keith was great asking Buchanan what the Republican strategy was these days or if they even had a strategy.
Pat thought maybe they did not have a strategy right now.
