I haven't seen much commentary on the Hamdan case.
For those of you who missed it, the Supreme Court pulled the rug out from under Bush's whole "war paradigm" legal interpretation of assumed extraordinary executive powers, including the assumed power to ignore international law, federal law, the Geneva Conventions and FISA.
The Hamdan case possibly opens the door to exploring whether Bush, Cheney, Rumsfeld, Rice et al, committed war crimes.
But that's not what I'm here to talk about today. Please DO look up the opinion of the Supreme Court in the Hamdan case and some of the commentary on it by Sidney Blumenthal and John Dean.
Below the fold, Senators DEFRAUD the Supreme Court.
The article cited here gives Kyl lots of room to spin his interpretation of what happened, but let me state it in terms that reflect REALITY.
Kyl, Graham and Brownback DEFRAUDED the Supreme Court
Basically, what they did was to craft a "Senate discussion" with an interpretation of the Detainee Treatment Act that was DEFEATED in the legislative process, and inserted it into the record after the vote on that legislation was already taken, attempting to rewrite the history of the debate to make it seem as if Senators in opposition heard this debate and either didn't answer it or agreed with it.
But that's not the whole of the story. AFTER these Senators manufactured this FALSE record of the debate in order to place a legislative intent in the record that was DEFEATED during the actual legislative process, they then filed a brief with the Supreme Court in the Hamdan case, representing this fraud as the true intent of the legislative branch with regard to the Detainee Treatment Act.
A few descriptions come to mind. FRAUD. CONTEMPT OF COURT. SUBVERTING the legislative process. OBSTRUCTION OF JUSTICE.
These assholes, in my opinion, should be arrested and held without bond, since letting them out on bail would enable them to further abuse their offices in a criminal manner.
At the very least, they should be disbarred. At the very least, an effort ought to arise to recall them from federal office, if they are not up for election this year.
ENOUGH IS ENOUGH. How dare these brazen assholes defraud the Supreme Court to make a case for the president to CONTINUE to defy the rule of law? Crimes in service of crimes! How putrid must the stench of racketeering be before someone throws these fuckers in jail?
