So with all the talk of the new SD law... while it is clear that even the most conservative areas of the country
are split on the issue, it is also clear that the Supreme Court will get the final say... (thank you professor Jay).
So we have Alito and Roberts as lifers but I feel like discussing where we all think the court is bound to go in years to come. To be honest I am not that afraid of this law delcared Constitutional as it is a pretty direct affront to Roe, more so than Casey. Therefore we can count on Kennedy's vote. This post is more to discuss future of SCOTUS cause I am looking for some discussion from fellow Dems...
The Obvious thought is that Kennedy is going to take O'Connor's place as the swing vote as is already hypothesized upon in the
Texas redistricting case.
However, I am curious if anyone like myself believes that Roberts may actually vote to uphold Roe, Stare Decisis and all that.
I guess my thoughts are that Scalito will remain a wingnut and that Roberts will mellow with age (especially as his kids reach teenage years), and Kennedy will move even further to the left then he has been.
IN the short I dont believe we are screwed just yet. Bush is not terribly likely to get a 3rd appointment, hopefully we will get a Dem in the presidents office or maybe a Dem Senate by the time next appointment comes around.
If we end up with McCain or Giuliani in 08 then we are even more likely to get Judges in the mold of O'Connor or Kennedy, (and I think its unlikely that we will get another winger in the executive office next time regardless)...
Soooo... thoughts?
