Senator Kennedy's Call to Arms

Senator Kennedy just had a conference call with a number of bloggers to update us on his and Senator Kerry's filibuster effort, and to encourage the netroots and the grassroots to keep up our efforts. He's very excited by what he's seeing here and throughout the blogosphere, and gave a great pep talk.

He is encouraging you to contact your Democratic Senators, regardless of what they might have said so far, but specifically mentioned Senators Pryor, Lincoln, Cantwell, Murray, Baucus, Harkin, Levin, Bayh, Lautenberg, Menendez, and Lieberman. In addition, he said to keep the pressure on Republican Senators Snowe, Collins, Chaffee, and Stevens.

Senator Kennedy talked in particular about one thing that I think is critical to keep in mind as we approach our Senators, and for them to keep in mind as they are considering this vote. We need to overcome the media noise machine by letting our Senators know that in voting their conscience, and making it clear that they are voting on principle, on conscience, they will overcome the media noise machine calling them obstructionists. We can help them realize this by letting them know that we've got their backs. That they are voting our conscience as well, and that we will not forget their courage.

Here are some more thoughts on breaking down the Republican talking points we know will be flooding the traditional media from Ed Kilgore:

I can only hope Senate Dems make a serious effort to stay focused on the Big Case against Alito during the debate.... It's especially important that they deal with the GOP "obstructionist" talking point by relentlessly reminding people that Bush deliberately picked this fight by giving conservative activists their very own Supreme Court nominee. And it wouldn't hurt to spend some time exposing the hypocrisy of "pro-choice" Republican Senators who are deliberately giving the anti-abortion movement the fourth vote they need--just one short of a majority--to erode and then overturn Roe v. Wade.

This is, as Senator Kennedy reminded us, a generational battle. Samuel Alito on the Supreme Court could turn back a generation's worth of progress in civil rights, in worker protections, in equality for women, in environmental protection, in the fight of the little guy against the corporation. And Samuel Alito on the Supreme Court will affect the generations to come. We cannot afford to refight the battles of the past 40 years during the next 40 years.

This is an uphill battle, but one in which we can at the very least achieve a moral victory. Approached with principle, with passion, and with vigor, a moral victory is not a hollow victory. As Senator Kennedy told us, "You don't ever lose fighting for principle, for what is decent and right. You don't ever lose when you have the power, the force of being correct."

      and didn't have a chance to follow up with that one. But Kennedy does apparently think he's in question. I could see Stevens being more in play once we actually know we have the filibuster in deciding whether to go nuclear. I think he's very uncomfortable with that idea.

              George Bush has two goals in nominating Alito. Short term, he wants Alito on the court for self protection. Alito really believes that anything the president does is legal, as long as he's a Republican. Second, Bush wants to roll back civil rights, women's rights, worker's rights, etc... We cannot allow Alito on the court. You may feel that this is a lost cause, that we cannot stop Alito from being confirmed. If this is true, we still must show that we understand why Alito has been nominated and why he is bad for America. We have to be on the record for the people's rights. That will help us to take back the congress and the presidency. You can't win a fight by sitting it out.

              History will not forgive us if we do not try and convict the neocoms for their crimes, every last one of them...

      However Ted Stevens feels about abortion rights (self-described pro-choice), he's a Republican first. Moreover, he is adamantly opposed to judicial filibusters; we went thru this in '05, folks.

      ... just a little bit of Stevens speech yesterday (could not stand for more), and to my surprise he was saying how difficult a vote this is for him, given his long standing pro-choice views. But that he is going to vote yes ofr reasons I did not bother to listen to. Quite a surprise, and proof once again that nothing is just black & white.

    They are saying they don't want to fight now because they don't think they will win. What they need to remember is that part of the reason they are in the minority more now than they were 2 years ago is specifically because no one believes they will fight for anything.

    They may lose this fillibuster fight, but they have to prove to people at large that they are willing to fight at all. Even if we lose this battle, once they show us they have the stomach to fight, we will be there with them for the next battle, and the next one, until we do win.

    I thought what I'd do was, I'd pretend I was one of those deaf-mutes...

    What we are doing is having an effect. As of yesterday he was undeclared. Today he is a no for Cloture. This is great news and shows the winds of change are blowing. It is difficult to support a filibuster against a hometown boy. It shows that he felt the pressure, and needs us for his election in the fall. Now we need Lautenberg. If both NJ Senators come out in favor of a filibuster that is major. Call Lautenberg.

    Don't have a vague message. Tell Democratic Sens, NO on cloture and to filibuster. Be prepared to say state your disapproval with what is happening to YOUR govt:

    • imperial presidency who thinks he is above the law
    • tearing up the constitution
    • cancelling out hard-won civil rights
    • overturning Roe v Wade
    • losing checks and balances
    • losing separation of powers, equal branches
    • not separating church and state
    • extremist court
    .
    Tell GOP Sens, whether or not that's your representation, to vote NO on cloture or to abstain from a cloture vote. As for the 'nuclear option', ask GOP Sens if they intend to blow up the Senate or nuke the constitution. (I got that last stuff from my Repug cousin -- can you believe it?     I'm glad to see this effort, but it would have been much more effective as a three month strategy rather than a last minute ploy.  I encourage everyone to keep at it, but I feel the movement to stop Alito would have been much more productive if these efforts has been started at a point other than at the last minute.

    The reason this is such an uphill battle is because everyone let the Republicans get the momentum on this nomination.  They came right out with their talking points and every dem said, "we'll wait and see."  We should have been out there every day saying that Alito is an extremist.  Perhaps, that way, the media would have been asking whether Alito is too extreme to sit on the SCOTUS rather than agreeing with each other about how capable he is and how his confirmation is inevitable.

    Momentum is like a snowball rolling down a mountain.  It's a lot easier to stop when it's small and not moving so fast.  But when it's a boulder and charging down the mountain and 120 mph, it takes a hell of a lot more effort to stop it.  Democrats have to stop waiting for the boulders.  In fact, it's time they started their own snowballs rather than just reacting to every one the republicans throw at us.

        but in this case, it is my opinion that a longer, more coordinated strategy would have been more effective.  The thing about it is this:  

        Even if we somehow manage to pull off a filibuster we're going to have to explain why we did it.  Now, the general public, for the past three months, has been reading about how qualified Alito is and how his confirmation is inevitable.  So if this filibuster happens, everyone will want to know why.  Republicans, I guarantee you, already have talking points in place should this happen.  And that will only reinforce the narrative that the media has been pushing for for months.  If, however, the story had been Alito's extremism, a filibuster would make much more sense to the general public.

        I want to make clear I'm not against these efforts.  What I'm saying is that, for a number of reasons, efforts to stop Alito may have been more successful.  Think of it this way - which would you rather have: democrats scrambling to get a filibuster or republicans scrambling to secure "yes" votes?

      You may not have agreed with my assessment of the situation, but was it necessary to rate me a 1?  There is nothing trollish about my post, nor is it abusive, sarcastic, or otherwise worthy of such a low rating.

      Remember that ratings are not about whether you agree with someone, but rather the 1s and 2s are for obvious trolls and people who are being purposefully destructive to the community.

    I think that goes without saying, whatever truth there may or may not be to the undending allegations that Kerry's doing this to set himself up for 2008.

    Having said that, though, I think that it is especially important for other leading Democrats to not only support and join his efforts, but stand up there and help him take the lead on it--especially those who aren't currently seen as likely '08 contenders.

    By doing so they'll not only give this effort some much-needed momentum and impact, but also help kill off all these secondary and cynical comments about Kerry's political motivations that have NOTHING to do with the very serious and substantial reasons for why we're so determined to block Alito.

    I didn't expect it to happen so late in the game, nor to be led by someone like Kerry (I thought Reid and Feingold would be the ones to lead it, but so much for talk about the boxer and the progressive), but I did expect it to be an uphill fight starting with what at first appeared to be a desperate and doomed effort on the part of a few lone voices within the party, supported only by the grass and netroots, and slowly gathering support and momentum.

    Well, that IS how it started, and that IS how it appears to be unfolding, as it slowly but surely gathers support and momentum beyond the roots, with the potential to turn into something really huge, and possibly even successful. And even if it "fails", it will still succeed, by showing us and the rest of the party and country that Dems can and do fight when sufficiently roused.

    To use a different but as I explained in another comment more appropriate historical term, I believe that this is our "Crossing the Delaware" moment.

    I believe that what makes Alito filibuster-worthy is that he refuses to repudiate unconstitutional acts.  

    • He refused to say that presidential "signing statements" have no legal weight.  Congress sets a law's intent, not the executive.  Congress can override of a presidential veto to pass a law, so the intent of Congress is the only intent with legal import.

    • He once ruled that shooting a fleeing unarmed suspect in the back was reasonable search and seizure.  

    • He refused to disavow himself of "unitary executive" theory, which posits that the executive can override legislative and judicial interpretations of constitutionality.  For example, under this theory, laws Congress wrote to codify constitutional limits on presidential power (such as FISA) could be ignored.  This is utterly ridiculous.  The legislative branch makes law, the executive branch carries out the law, and the judicial branch resolves legal disputes.  

    What's the talking point for this?  "Alito would make illegal rulings"--?

    I am so glad to see Democrats fighting the Alito nomination. I really hope for a filibuster. I have been calling my senator's offices but Bayh's mailboxes are full (I will try again tomorrow and for sure Monday).

    I want to believe we have learned a lesson from how the voting went before the run-up to the Iraq war. When you just go along-to-get-along, neither in or out, it makes it very hard to come back later and be able to say, "I told you so!".

    Unfortunately, "I told you so!", may be one of the most important things that a minority party can set itself up to say down the road. But you MUST have made the right decisions during the foreplay so that you have the opportunity to bask in the afterglow.

    I believe one primary factor that has hurt Democrats badly, since the Iraq fiasco, has been the inability of so many representatives to be able to be able to shout, with any sense of credibility, "I told you so!".

    Don't you think things are going to get worse under Alito? You must or you wouldn't be this upset about him. Don't you think most Americans will eventually get it as the reality of the court decisions change the very fabric of their society? (no activist judges my ass). Even if we can't stop it shouldn't we put ourselves in a position to be able to say politically," I told you so!"?

    So do the right thing, fight Alito to the best of our ability and then, no matter the outcome, call it a day. Sometimes a progressives gotta do what a progressives gotta do.

      Anyone know where he stands? I emailed him on Thursday, tried to call his office on Friday but couldn't get through. Last I heard he was on board for a filibuster (in another thread here somewhere), but I don't see him on either list.

    I am a lurker here, mostly, but committed and rabid, so excuse me if I am posting outside of protocol.  Since all voice mailboxes are full and lots of faxes aren't going through, is there a good reason for not e-mailing?  And is there a good master list for e-mail addresses (come  on, one of you must have it) rather than filling out the entire, infermal form on twenty-plus websites? Also, I just sent a blast fax via savethecourt.org, but it includes some names that we now know have shifted into our column.  Does anyone have a blast fax link that is more updated?  Thanks to all.  And the senator is right.  You NEVER lose by doing the right thing, in any area of your life.
