By hiring employees based on their political affiliation, the Department of Justice is in violation of the so-called No FEAR Act. The Notification and Federal Employee Anti-discrimination and Retaliation act was signed into law by President Bush on May 15 2002. The law says in part:
The Department of Justice cannot discriminate against an employee or applicant for Federal employment with respect to the terms, conditions or privileges of employment on the basis of race, color, religion, sex, national origin, age, disability, marital status or political affiliation.
If the Senate Judiciary Committee proves that DOJ discriminated against Democratic applicants, anyone involved should lose their job.
Under the existing laws, the DOJ retains the right, where appropriate, to discipline an employee for conduct that is inconsistent with Federal Antidiscrimination and Whistleblower Protection Laws up to and including removal.
The No FEAR Act requires government agencies to:

Post statistical data relating to Federal sector equal employment opportunity complaints on its public website
Ensure that their managers have adequate training in the management of a diverse workforce, early and alternative conflict resolution, and essential communications skills
Conduct studies on the trends and causes of complaints of discrimination
Implement new measures to improve the complaint process and the work environment
Initiate timely and appropriate discipline against employees who engage in misconduct related to discrimination or reprisal
Reimburse the Judgment Fund for any discrimination and whistleblower related settlements or judgments reach in Federal court
Produce annual reports of status and progress to Congress, the Attorney General and the U.S. Equal Employment Commission
I did find the statistical data for 2006 on the DOJ website; However, there was no data for political affiliation. And the data only cites complaints, not all cases of political discrimination.
As far as "timely and appropriate discipline against employees who engage in misconduct related to discrimination or reprisal", I seriously doubt that the Abu G Justice Department is going to disipline anyone for favoring Republicans in their hiring practices. They are likely to encourage it.
The DOJ is acting in violation of the No FEAR Act, and the law could be used to rid the DOJ of many partisan Republicans who favor party over country.
