They'll fuck it up, of course, because they're fucking useless, but right now they have the chance to take back their power and to stop the runaway train that is the Bush Administration.
This is going to be a short diary, but what the hell. If Bob Johnson can write short diaries, so can I.
Disclaimer: I'm not a lawyer, so this is being written from a lay perspective based on my understanding of how all this stuff works. If I get something technically wrong, feel free to spank me in the comments.
Bush is handing Congress [even more] grounds for impeachment on a silver platter with his latest executive order.
It's simple, really. What Congress needs to do is to pursue both criminal contempt through the DOJ and inherent contempt, simultaneously. And they need to do it now. Forget the August recess, people. Suck it up like the rest of us who don't get month-long summer vacations, stay in Washington, and for once in your lives do your damn jobs.
If Congress pursues inherent contempt, and graciously invite Ms. Miers to present herself before the House of Representatives within 24 hours to answer the charge, and if she refuses on orders from Bush, then Bush has committed an impeachable offense.
If Congress pursues criminal contempt against Harriet Miers and Josh Bolten for ignoring subpoenas through the USA for the District of Columbia, and if Bush orders the USA to ignore them, then Bush has committed an impeachable offense. (Note: I would strongly recommend that Congress invite the USA for D.C. to recuse himself before even asking him to file contempt charges, since the guy's up to his ass in the muck that is the DOJ scandal.)
Why pursue both simultaneously? Well, for one, because of the two chances to get Bush committing [two more] impeachable offenses. And for another, because the criminal contempt process will take too much time, particularly of the USA does recuse himself and a special prosecutor needs to be appointed. And for a third, it's time for Congress to start enforcing the law via inherent contempt. It's time for them to take back their power and restore some sense of balance to the federal government. It's time to get Bush out of the White House once and for all.
And if they don't do it, then they're committing treason.
