Once again the Supremes have handed Bush II a gift of more imperial power. Yesterday they declined to hear an appeal in El-Masri v. United States.

It all began when Khaled el-Masri was kidnapped by the CIA while on vacation in Macedonia in late 2003, transported by the United States to Afghanistan and held there for five months in a secret prison, during which time he was tortured repeatedly.
El-Masri sued the USG in 2005, but without comment, the Supremes let stand an appeals court ruling that "state secrets" protected the government’s actions from court review.
We are in the company of Communist China, the now dead Soviet Union, and numerous other disgusting regimes. When I was a young person I believed society and life would get better, not worse. But under the imperial conservatives things are worse. This must be how it felt to be a republican when Augustus declared himself emperor of Rome.
