The fact that only 4 Senators stood to protect the people of the United States from the KGB like activities of the FBI and Mr. Mukasey shows how far wacked this country has gone.

Four Democratic Senators — Russ Feingold of Wisconsin, Sheldon Whitehouse of Rhode Island, Richard Durbin of Illinois and Edward Kennedy of Massachusetts — have written to Mr. Mukasey and urged him not to sign the guidelines until they are publicly announced and national security and civil liberties experts have had a chance to analyze them.

When Mukasey's nomination was being debated in the Fall of 2007, The New York Times reported on Feinstein's support of Mukasey:
Senator Dianne Feinstein, Democrat of California, said she was confident that Mr. Mukasey would be nonpartisan and that his refusal to make a judgment on torture without knowing all the facts of interrogation policy should not keep him from the post.
"This man has been a judge for 18 years," said Ms. Feinstein, who along with Mr. Schumer provided the key supporting votes to push Mr. Mukasey through the Judiciary Committee. http://www.nytimes.com/...
Schumer's and Feinstein's work on Mukasey's behalf were deemed essential to his confirmation by the Senate. No Republicans voted against Mukasey's confirmation. Democrats Bayh, Carper, Feinstein, Landrieu, Nelson, and Schumer gave Mukasey the needed margin, along with the vote of Independent Joe Lieberman.
Senator Mary Landrieu is currently seeking reelection.
Senator Dianne Feinstein is said to be eyeing a run for governor in 2010.
Senator Evan Bayh is widely assumed to be a top prospect on Barack Obama's "short list' for the vice presidential nod.

Why, one might wonder, have only four senators objected? Why is not a majority of Congress - Republicans and Democrats - demanding that the White House clear the air about the proposed guidelines - something that hints at a frightening infringement of Americans' constitutional rights. This includes the Fourth Amendment, which guarantees "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."There is, according to the newspaper, little information about the proposal. The letter to the Justice Department warns the plan "might permit an innocent American to be subjected to such intrusive surveillance based in part on race, ethnicity, national origin, religion, or on protected First Amendment activities." It was signed by senators Russ Feingold of Wisconsin, Richard J. Durbin of Illinois, Edward M. Kennedy of Massachusetts and Sheldon Whitehouse of Rhode Island.
