This just in from Barr's web site, McCain nor Obama qualify for the Texas Ballot.
Sorry for the short diary that everyone hates, but Bob Barr says that Barack Obama and John McCain don't qualify for the ballot in Texas! He cites S 192.031 in the Texas code of elections as his arguement, that "requires written certification of the parties nominees" to be delivered 10 weeks before the election, and since neither canidate had been nominated, he says it is impossible to file. Barr also said that third parties that missed the deadline didn't get on the ballot, so that means they were being selective. He also cites a ruling in 2006 that "does not allow political parties or canidates to ignore statuary deadlines". Impressive arguement, don't you think?
Now I think that this won't come out in Barr's favor. If it does (and it seems he doesn't have that bad of an arguement) then thats 34 electoral votes not in McCain's favor. That would be devastating to the McCain campaign.
I hope Barr wins this case (it would be fun seeing 3 colors on a map, and Texas not Red). It would be historical for Libertarians. First time winning a state, we might become more like Europe with three main parties, nah. It probably won't happen, but... you never know.
