So, youtube took down videos because of DMCA claims asserted by the media What can I say but tough shit. It happens all the time. Not just to me, but to fans who produce fanvideos, or even filmmakers who spend half a decade obtaining permission to film in another country only to see their work taken down without notice by a DMCA takedown that only applied to three videos in their account. or, who had the same tags (colbert, stewart. Why, it even happens to the OBAMA campaign, so STFU, sir. No one likes a whiner. Not even other whiners.

Is this what you mean by example? Just more "do as I say, not as I do" bullshit? People lose accounts at youtube every singel day for lesser offenses. Why not just contact the artists or news outlet and inform them of your intent, then ASK.
According to the EFF article, and your own letter to youtube, you are indeed asking that "Some speech be freer than others":

I see a slippery slope here, Johnny. If SOME speech is freer than mine, then criticism, satire and other forms of expression could be suppressed. Oh, you'd love that - no one being able to make fun of your doddering ill-tempered nature.
My solution, Johnny, has been to take what I believe to be Fair Use clips and apply the Code of Best Practices. Is your video designed to encourage discussion? if it is, no problem. If it's designed to provoke the basest of human emotion from what is left of your base, then, no. Does it use a small amount of footage? Then, you're probably ok. If it uses "too much" without comment, then no. You have brought down the wrath of the News media who prefer to keep their biases closeted. But, then, when FOX asks you to "Stop" you know you have a problem
