[EDIT: Is my timing great or what?] Can we put this one to bed? This "retake the Oath" nonsense is silly and I'm sick of the diaries that keep popping up.
First, Obama signed a written oath after the ceremony. That should be more than sufficient to satisfy any Constitutional oath requirement, assuming such a requirement actually exists. Which is in doubt, because ...
Second, the 20th Amendment arguably supersedes the necessity of an Oath. Amendment govern over conflicting language in the document they amend.
Third, even if Obama didn't properly take the Oath, no one has standing to sue him and preclude him from taking office. The standing defense is very real, as the folks who sued Obama and McCain claiming they weren't citizens found out. So, at best, this is a non-issue.
Fourth, even if somehow a court decided that someone did have standing, by the time a suit made it to court Obama would have signed so many laws and proclamations that no court would ever possibly rule he wasn't President. It's bring a crisis, and for no reason since there's no question he won the election, won the Electoral College vote, etc.
Fifth, substantively, the notion that saying one word out of order, with no change in meaning to the oath, somehow negates it is absurd. No judge, no matter how strict a constructionist of the Constitution, would ever make such a ruling, especially when the fault was the conservative Chief Justice of the Supreme Court.
This whole thing is laughable. And the discussion should end.
