The University of Colorado says that Ward Churchill was treated fairly when he was fired. Some ethical problem so small, that it couldn't be considered misconduct because there was no "clear and convincing" evidence. But your still fired. Now compare that to a much bigger case at University of Oregon where the shoe is on the other foot......
At the University of Oregon, the President's office defends the fact that they gave a Ph.D. to a certain Paul White Lewis (missionary) who planned to go to Thailand and sterilize Akha women (minority hill tribe) to please the Thai government.
He did sterilize hundreds if not thousands of these women, and came back to Eugene where the Univ. of Oregon gave him his Ph.D.
While the University does not dodge the bullet, that the women were not sterilized with Free, Prior and Informed Consent, they basically don't see how sterilizing a bunch of minority women is a case of fraud, dishonesty, immorality or just plain white genocide against brown people.
The evidence in the case that this was a sterilization project to please the Thai government, and to please Mr. Lewis' sense of religion, are quite compelling, but apparently no reason to overturn a Ph.D. They said that Ph.D.'s are only rescinded in cases of dishonesty, but the University of Oregon doesn't see Genocide as a case of dishonesty.
While a shred of doubt is enough to defend getting rid of Mr. Churchill, all the evidence in the world that a Ph.D. student targeted minority woman for a sweeping sterilization program is not enough to get the white boys at the University of Oregon to roust one of their own.
