Maybe I'm really missing something here, but my understanding is that only 41 votes were needed to sustain the filibuster (filibuster = continually voting NO on cloture for those who may not understand cloture) against Scalito and there were 42 votes against confirmation.
So why in the hell would someone vote against confirming him, but not DO FUCKING ANYTHING ABOUT IT!!!!!!!!!!!!!!!!!??????????? I'm really perplexed. Can someone help me out of this quagmire or illogical bullshit? It's like walking by a dog turd in the yard, complaining about it, telling everyone you know why it shouldn't be there and then
NOT PICKING THE FUCKING THING UP! Below the fold is the list of Senators who voted for Cloture, but against Confirmation. These are the one's we need to get out of the Democratic party. We need to find qualified, Hackett-esque candidates to run against them and funnel all our energy and resources into seeing that someone else wins the Democratic primary on their next election (with the exception of Chafee who's a Republican).
THE List
Akaka (D-HI)
Baucus (D-MT)
Bingaman (D-NM)
