California, Code of Civil Procedure § 1279.5 and Family Code § 2082 regulate common law and court decreed name changes. Code of Civil Procedure § 1279.5 (a) reads, "Except as provided in subdivision (b), (c), (d), or (e), nothing in this title shall be construed to abrogate the common law right of any person to change his or her name." Subdivisions b through e preclude one from changing their name by common law if they are in state prison, on probation, on parole, or been a convicted sex offender. If a person is not in any of these categories, then a common law name change is allowed. Family Code § 2082 also specifically states, "Nothing in this code shall be construed to abrogate the common law right of any person to change one's name."

Remember me? the one with the REAL-ID issue here in Jersey? I got laid off yesterday. and, because of REAL-ID, I CAN'T COLLECT UNEMPLOYMENT IN THE STATE OF NEW JERSEY,
and, because you think think the right to carry large sums of cash is more important than someone's right to carry identification from the state they reside in, I cannot apply for Unemployment Compensation. Because you think REAL -ID is not "sexy" enough for you, I face eviction in February, unless I can find a job before then, that will pay what I way making.
When we spoke on the phone last year, I said I was willing to go public with this. You asked if there were "skeletons", if I were a "felon" and other questions you had to ask. I answered all of them. I never heard from you again. Much like a one-night stand and the promise to call. You didn't mean what you cooed into my ear. I went to my STATE Senator (Sen.Rice, Dem, Essex County), who is working on the issue - I sent him the same letter I sent Sen. Lautenberg, but this time, I sent him the California Civil Code regarding Common Use Name Change as well.
So, what good are you to me, if I don't have a sexy case attached to a connected individual or if my situation isn't "newsworthy"? When this is resolved, it will be no thanks to you. It will be because I did it. Without the assistance of those that are supposedly interested in Civil Liberties.

UPDATE: with my tail tucked between my legs, it is very apparent, that no one here cares about the legal,financial and civil ramifications of THE REAL-ID ACT OF 2005. It with a sad and broken heart, I say goodbye. I hope, none of you go through what I have gone through, and still going through.
