Elena appears to be following Chicago's (those in-the-know simply say "Chicago") long-held Durkheimian sociological model that some people are special, some businessess are special. Some like Goldman Sachs are too big to fail.
Elena Kagan is all about corporate exceptialism. Maybe Kagan is right and maybe Kagan leans to the right when it's about finance and big business.
