Colorado' Attorney General has announced he will join the other obstructionist AGs in challenging the Health Care Act
Suthers said Monday he would join fellow Republican attorneys general and at least nine other states in opposing the bill because he thinks a provision requiring most Americans to purchase insurance is an unconstitutional expansion of federal power. Congress has the right to control interstate commerce but can't force people to participate in commerce, he said.
Governor Ritter opposes the move but has no direct leverage.
However, the Legislature could stop this, and here is my email to my Senator encouraging the Senate to act.
Sen. Whitehead,
I just read in the Attorney General intends on joining the litigation that would challenge the newly enacted health care legislation. I urge you to put forward a measure that would prohibit the expenditure of any State funds for that purpose. This litigation has little or no merit based on the existing Supreme Court precedents regarding the scope of the commerce clause. As such, it is a complete waste of state funds. Moreover, this challenge is not in the interests of the residents of Colorado. The benefits from this legislation will far outweigh the burdens. This bill reflects at historic measure that Colorado should embrace. The opponents of healthcare have been fighting this battle since the days of Teddy Roosevelt and they have finally lost. However they refuse to accept that this country wants to join the rest of the world in providing healthcare to all of its citizens. This litigation is the last gasp of that effort. I urge you to do everything you can to stop this obstructionist activity and send a signal that Colorado is eager to move into the 21st.
