Please, liberals, take the time to read the Schiavo bill and Judge Birch's concurring opinion on the bill as violating the constitution. (both on findlaw). Until I read the bill I had assumed that it was merely impulsive and naive. Reading it, however, it seems far more likely that the drafters were quite aware that they were undermining the rule of law. Never have I seen such an evasive, timid, cloudy piece of legislation, so suggestively the work of knowing miscreants. It speaks well of us as a people that such executive/legislative skullduggery has been so rare. Judge Birch's opinion cites the blessedly small number of precedents. Those interested in pertinent consitutional theory can see Madison (federalist,47-55) Adams and Montesquieu.
What is appalling is the extent to which legislators were willing to trample the Constitution, the courts and fundamental American rights.
