Believe it or not there are reports circulating among the Wrong-Wing of exactly that.

Dictator... Obama Issues DREAM ACT by Executive Order..
DIRTY, DIRTY, DIRTY – President Obama Issues DREAM ACT Executive
Yeah, I certainly can't remember any time in recent history where a President would Dare to Go Rogue and implement policy as an executive order despite what Congress did or didn't do.
Well, except for all those signing statements of President Bush.
Here's the Obama "tragedy of Amnesty" in the words of that panicked...
On Friday, the Obama administration issued a memo announcing that federal immigration officials do not have to deport illegal aliens if they are enrolled in any type of education program, if their family members have volunteered for U.S. military service, or even if they are pregnant or nursing.
This new policy of “prosecutorial discretion” was quietly announced on Friday afternoon, and completely ignored by the mainstream press.
Y'know that actually sounds pretty good to me. What else?
Author of Arizona’s SB1070 and Kansas’ secretary of state, Kris Kobach, told the Daily Caller: “They’re pushing the [immigration] agents to be even more lax, to go further in not enforcing the law. At a time when millions of Americans are unemployed and looking for work, this is more bad news coming from the Obama administration… [if the administration] really cared about putting Americans back to work, it would be vigorously enforcing the law.”
Yeah, there are so many Americans just raring to do backbreaking physical labor for chickenfeed with no healthcare, benefits or workers-compensation. We see how well that's working out for Agriculture in Georgia after they passed their own SB1070 copy. They can only get Ex-Cons to do these jobs. So let me get this straight, rather than have our food harvested by people - some of whom might be suspected of having crossed a line on a map without a pass, we have people who've been convicted of violent crimes doing it?
I believe in redemption and 2nd chances just like the next guy, but I find that kind of public safety strategery more than a little crazy.
Secondly, the Obama Administration has be the most aggressive in history at implementing immigration law and deporting those who've entered illegally, especially when they've been involved in crime.
As has been documented, the combination of the slow economy and aggressive deportation has actually reduced the total number of undocumented in the U.S. from 12 Million to 11 Million. That's the first decline in 20 years.
But you wouldn't know that listening to these guys.
Late last year, the so-called DREAM Act which would give legal residency status to millions of illegal aliens who attend college or join the military was defeated in the Senate. Every major poll has shown that the American people are overwhelmingly opposed to the DREAM Act as well as to any other form of amnesty.
Every Major Poll? Hmm...
Opinion Research Poll 6/30/10 : 70 Percent Support the Dream Act
Rasmussen 9/21/10: 52 percent support Dream Act
Gallup Poll via CNN Political Tracker 12/10/10: 54 Percent Support the Dream Act
Not quite Every Poll...
And why would Obama do this?
However, with Obama’s poll numbers plummeting, this use of his executive powers is seen as an obvious ploy to solidify the Latino vote in the 2012 presidential election.
Obama's Poll Number are plummeting? Or did the Bin Laden Bounce finally wear off?
Wow, look at that -he's collapsed all the way down to a level that's just two points higher than he was several weeks ago. Obviously it's time for him to do something drastic, like announce that our troops are go to start leaving Afghanistan, or y'know - Grants Some Amnesty to those Damn Dirty Illegals.
Oh, and about the "Prosecutorial Discretion" which the Conservos referred to in quotes - well, the actual document they huffing and puffing about here actually isn't an executive order at all - it'a Prosecutorial Discretion Memo issued by ICE (which if I recall are actually several pay grade below the President).
http://www.ice.gov/...
Factors to Consider When Exercising Prosecutorial Discretion
When weighing whether an exercise of prosecutorial discretion may be warranted for a given . alien, ICE officers, agent s , and attorneys should consider all relevant factors, including, but not limited to
• the agency's civil immigration enforcement priorities;
• the person's length of presence in the United States, with particular consideration given to presence while in lawful status;
• the circumstances of the person's arrival in the United States and the manner ofhis or her entry,particularly if the alien came to the United States as a young child;
• the person's pursuit of education in the United States, with particular consideration given to those who have graduated from a U.S. high school or have successfully pursued or are pursuing a college or advanced degrees at a legitimate institution of higher education in the United States;
• whether the person, or the person's immediate relative,has served in the U.S. military, reserves, or national guard, with particular consideration given to those who served in combat;
• the person's criminal history, including arrests, prior convictions, or outstanding arrest warrants;
• the person's immigration history, including any prior removal, outstanding order of
removal, prior denial of status, or evidence of fraud;
• whether the person poses a national security or public safety concern;
• the person's ties and contributions to the community, including family relationships;
• the person's ties to the home country and condition~ in the country;
• the person's age, with particular consideration given to minors and the elderly;
• whether the person has a U.S. citizen or permanent resident spouse, child, or parent;
• whether the person is the primary caretaker of a person with a mental or physical disability, minor, or seriously ill relative; ;
• whether the person or the person's spouse is pregnant or nursing;
• whether the person or the person's spouse suffers from severe mental or physical illness;
• whether the person's nationality renders removal unlikely;
• Whether the person is likely to be granted temporary or permanent status or other relief from removal, including as a relative of a U.S. citizen or permanent resident;
• whether the person is likely to be granted temporary or permanent status or other relief from removal, including as an asylum seeker, or a victim of domestic violence, human trafficking, or other crime; . and .
• whether the person is currently cooperating or has cooperated with federal, state or local law enforcement authorities, such as ICE, the U.S Attorneys or Department of Justice, the Department of Labor, or National Labor Relations Board, among others.
This list is not exhaustive and no one factor is.determinative. ICE officers, agents, and attorneys should always consider prosecutorial discretion on a case-by-case basis. The decisions should be based on the totality of the circumstances, with the goal of conforming to ICE' s enforcement priorities.
Essentially, it's a legal opinion by the ICE's internal council and a statement of priorities. and yeah it does look essentially like the Director of ICE has put the Dream Act into practice (except for creating a path to citizenship for law abiding undocumented persons) even if it isn't a current matter of law. Obama signature is NOT on this document, it's a policy that could easily be reverse by the next Director of ICE.
Gee, It seems to me that there were some rather famous internal legal memos from a couple years back. What were they again....
Oh yeah, the OLC Torture Memos which essentially established that anything Just Short of Murder was Legal.
So when a bunch of lawyers say that torture isn't torture anymore, the Right-wing is all behind it - when it's says maybe you shouldn't deport people when their in college, or pregnant, or they have family in the military - that's a bad thing that hurts American Jobs.
That is of course, when the GOP isn't deliberately Hurting American Jobs themselves just to RatFuck Obama's re-election campaign.
Yeah, we can see exactly what their priorities are.
