I know, not a diary. And once this hits the front page, I will delete. Just wanted to get the news out there(since the press conference is dominating things now), that the 6th Circuit Court of Appeals has upheld the President's healthcare law!

We find that the minimum coverage provision is a valid exercise of legislative power by Congress under the Commerce Clause and therefore AFFIRM the decision of the district court.” More coverage to follow.
Some details: The three judge panel here split 2-1 in favor of affirming the district court's ruling which stated the law was constitutional. There were two GOP appointees, so at least one voted that the law is constitutional, a break from the party line decisions we have seen at the district court level.
This is the first appellate court to rule on ACA, I believe. Two others are considering the case, the 4th and 11th. Supporters of the law have their strongest chance at the 4th, while I think the 11th might strike some or all of the law down.

By regulating the practice of self-insuring for the cost of health care delivery, the minimum coverage provision is facially constitutional under the Commerce Clause for two independent reasons. First, the provision regulates economic activity that Congress had a rational basis to believe has substantial effects on interstate commerce. In addition, Congress had a rational basis to believe that the provision was essential to its larger economic scheme reforming the interstate markets in health care and health insurance.
