Last night the rubber truely hit the road here in St Louis. After attempting to get the issue dpermit to allow post-curfew access to the park, the message at 6pm was that the mayor's office was sorry and that the curfew law was unconstitutional but since it is on the books they need to enforce it. It turns out that the Director of City Parks and Services CAN grant a special order to allow the curfew to be ignored.
More after the sexually-active Golden Age ampersands:
Last night citations were issued to everyone that was present at the park after 10 PM.
This is in DIRECT VIOLATION of both the 1st Amendment right to assemble and the 9th Section of the Missouri State Constitution that extends that right to anyone inside Missouri.
At this time, Occupy St Louis needs everyone's support to fight these fines. Whether that is actually coming to the park after curfew to generate your own pass to Constitutional Law Proceedings or just lending moral support, its all good!
Thu Oct 06, 2011 at 11:49 AM PT: UPDATE - 10/06
10 protesters were arrested last night at Keirnen Square for occupation after curfew. The rubber has officially met the road.
Emails and phone calls have been placed to St Louis City Aldermens' offices to get the curfew law repealed in respect to peaceful demonstrations. There are laws on the books about non-peaceful demonstrations so teh curfew law has nothing to do with our 1st Amendment rights which as also protected under the 9th Article of the Missouri State Constitution.
If the City government is not interested in being sued for a 1st Amendment breech, they should have no problem getting this ordinance reworked or recalled.
