What would Rose Kennedy do about Occupy Boston?
Whoever gave the green light for Boston Police Commissioner Ed Davis to have his police troops charge the Rose Kennedy Greenway in the middle of the night and, under the cover of darkness, to cuff and arrest a bunch of Veterans for Peace, legal observers, medics, students, laborers and unemployed people needs to get better advice.
Occupy Boston and its nationwide counterparts are about as pure an expression of political speech as one can imagine. Citizens from around the country, increasingly frustrated at their inability to be heard in Washington, are gathering peaceably in Boston and other key cities around the nation in an effort to have their say in the future of our nation. Until last night, Boston provided one of the models for defending peaceable political protest. (In fact, I also applauded Boston for welcoming Tea Party protesters to Boston recently.)

Anti-War Protesters Storm Senate’s Hart Office Building
Members of the anti-war Stop the Machine and October 11 movement attempted to take over the atrium of the Senate Hart Office Building on Tuesday, chanting "we are the 99 percent" and "end all wars" before Capitol Police cleared the area and made a handful of arrests.
Stop the Machine and October 2011 protesters were the chief organizers, but were joined by people who said they came to town for the Occupy D.C. protest. Some of the chants also took on the branding of the "Occupy" movement, including chants about taxing the rich.

Protesters Arrested On Capitol Hill In Hart Senate Office Building
WASHINGTON -- Several protesters were arrested late Tuesday morning on Capitol Hill, part of the ongoing demonstrations inspired by the Occupy Wall Street protests in New York City. According to TPM, protesters marched from Freedom Plaza to the Hart Senate Office Building, where they assembled in the building's large multi-story atrium:
About 75-100 protesters from the October2011 occupation of Freedom Plaza marched from the Plaza to the Hart Senate Office Building this morning to confront Congress about its refusal to represent the people who vote for them and their incompetence in the face of economic crisis and unending war.
As of 11:40 this morning, police began arresting some of the demonstrators, including Dennis Trainor from the October2011 Steering Committee.

Now police may want to do this and they may go ahead and do this BUT... They should not do this. Both because there is clear legal precedence on this and because it just is not a smart political move for them.
We may need to get ready to help bail out some of them... The police have threatened to arrest them if they are there, tents and all, in the "morning". Lawyers were there explaining the rights to the people that are camping out.
Yes... They may choose to arrest them but apparently there is a Second Circuit Court of Appeals decision from 2000 that does protect their rights to protest there, tents and all. And you can thank the New York City homeless for that.
The lawyers are working on getting an injunction to stop the police, and they seem confident they can get it considering the legal precedence involved... But before they can get an injunction some people may end up getting arrested.
So it all amounts to harassing protesters needlessly. And before you spread this around to other Occupations:
Not all states are protected by this Second Circuit decision.
And whether or not the Hartford police choose to act still remains in question. They may just be making threats in the hopes people leave.
Anyone got a contact in Hartford city hall that may be able to stop this? Tactically for the police and the government? Ignoring protesters' clear rights is not a good idea. Nor will it look good politically.
Because they can arrest them and force the protesters to get an injunction to keep the police from doing it again... Or the police could do it the easy way and just let the protesters be, rights intact and all.

DAY 4- Late Monday afternoon Chief of Police Darryl K Roberts came to Turning Point Park and told us that we need to take the tents down first thing Tuesday morning (Oct.11). At the same time, he also informed us that City Officials would like to have a meeting with us. During the General Assembly, the consensus was that we would take down the tents at 7am and meet with them Tuesday, late afternoon.
It is absolutely necessary that we get as many people down to the occupied park! We especially need a critical mass of people here at 7pm for a solidarity rally, but we also encourage folks to come down at any point in the day.

Occupy Philadelphia regularly updates its board of daily activities, written on adhesive notes. "We're here for a longtime occupation," Ross said, "so we've got to make sure we're flexible."
After a sunny start, Occupy Philadelphia is expecting rain soon, and needs tarps, tents, ponchos, blankets and warm clothing, and lidded plastic storage bins to keep medical supplies dry.

Statement from Veterans For Peace Regarding the Incident in Boston Last Night, by Acting Director, Mike Ferner
Last night in Boston, our members displayed real courage, standing nonviolently between police and people in the Occupy Boston protest. Police were given orders to clear the park and initial reports I've heard say that some VFP members and perhaps others were injured by the police and that fifty people were arrested. If there were injuries, we hope they were minimal. VFP never condones the use of violence.
We need to keep in mind that police officers are in the same 99% as we are, providing the muscle, sweat, blood and money used by the 1% who own and govern. The most important thing we share with the police is our humanity. We appeal to police in every corner of America to maintain their humanity and think about it when they consider orders they are given.
The largest democratic uprising in U.S. history was that of the Populists in the late 1800's. Of them, Lawrence Goodwyn, author of "The Populist Moment," wrote that they "...created the psychological space to dare to aspire grandly." That is what the dozens of "Occupy" movements are doing throughout America today -- daring to aspire grandly and aspiring to the grandest ideal of our nation, which is democracy.
We are just at the beginning stages of a powerful, new rising of democratic energy and ideals. We will remain human but we will remain silent no longer.

Police in Boston arrest 129 in protest crackdown
WASHINGTON — Police in Boston arrested 129 protesters on Tuesday, a police spokesman said, in one of the biggest crackdowns so far on the Occupy Wall Street movement that has spread across the United States.
Boston Police Department spokesman Eddy Chrispin said "a majority" had been arrested for unlawful assembly when police converged on the crowd in the early hours of the morning.

And it turns out that big financial service firms have also been buying protection via the NYPD. Literally.
Pam Martens in Counterpunch (hat tip reader 1sk) describes a program which allows private firms to pay the city to put a cop on the street to police for them. I am not making this up. Oh, and the white shirted cops that seem to be more aggressive in going after protestors (most notably, the one that infamously maced a group of women?) The assumption has been that they are supervisors. Martens suggests they are in the employ of businesses

The “Stand Up Chicago” marchers came in five downtown streams Monday afternoon, converging into a river of frustration, anger and dissatisfaction outside the Art Institute’s Modern Wing, where a reception was being held for the Futures Industry Association, which is holding its annual Chicago Expo.

3) We sent a small delegation of people to city hall to apply for the permit. The terms were that the permit would cover an indefinite amount of time. The city did cover the application fee. 4) The City Council went in to a closed meeting without a representative from our movement. A permit was issued late in the evening. Occupy Dallas was not notified. The permit was discovered online by a member of our staff. 5) The permit issued by the Dallas City Council had specific terms which Occupy Dallas must fulfill for the permit to be valid. It included a 1 million dollar insurance policy. 5) According to the application on dallasspecialevents.com, "If the estimated number of participants and spectators exceeds 2,500 during any day of the special event, the applicant shall procure and keep in full force and effect for the duration of the event insurance written by an insurance company approved by the State of Texas." We do not meet those requirements. 6) Occupy Dallas is now focused on one issue: We don't need a permit to be here. The first amendment guarantees our right to protest. A lack of permit cannot legally be used to force us from Pioneer Park. 7) If asked to leave, a General Assembly has authorized our protest team to engage in civil disobedience.

Wall Street protesters are planning a “Millionaires March” to the homes of some of New York’s wealthiest residents this afternoon. Between 400 and 800 protesters are expected to leave their base in Manhattan and march to the uptown homes of JP Morgan CEO Jamie Dimon, News Corp. CEO Rupert Murdoch, and billionaire businessman David Koch, among others.

Boston Police Throw American Flag To Ground, Arrest Veterans, Trash Property To Protect ‘Green Space’ From 99 Percent
In one of the largest mass arrests in recent Boston history, the Boston Police Department cleared a park of activists with the 99 Percent Movement in the early hours of Tuesday morning, dismantling and destroying tents that had been set up on Monday. Startling footage shot by an onlooker shows members of Veterans for Peace, an organization of U.S. military veterans who oppose war, being arrested by members of the Boston Police Department, their flags — including the American flag — being thrown to the ground:

Mass Arrests of Occupy Boston Protestors
Over 100 Occupy Boston protesters arrested in massive police crackdown.
At 1:20 am, police moved in with more than 16 police vans along with police cruisers and unmarked vehicles on Atlantic Avenue in downtown Boston. Officers dressed in black and equipped with plastic handcuffs surrounded part of the camp, protesters were given a five minute warning to leave or be arrested. Most protesters remained, linking arms with each other and peacefully resisting. Police moved in and, according to Boston.com, “each protester was individually put on his or her stomach, cable-tied, and dragged off as others tore down tents and arrested and detained people on the fringe of the park.”
Eye witness reports and video have come in showing that police dealt violently with members of Veterans for Peace who had come to support Occupy Boston. Other reports are still coming in regarding other instances of police brutality, but remain unconfirmed.
Some street medics, clearly marked with red crosses, were arrested despite repeated requests for medical attention from some of the protestors. One street medic on the scene who was not arrested said that police refused to call EMTs. There have been no reports of pepper spray being used on protestors.
