The US Supreme Court, in the case of an ordinance prohibiting people on a public street from distributing flyers on the basis that littering caused the streets not to be "clean and of good appearance" invalidated the ordinances. Schneider v. Irvington, 308 US 147 (1939).
In Hague v. CIO, 307 US 496 (1939), the Supreme Court said:
Wherever the title of streets and parks may rest, they have immemorially been held in trust for the use of public and, time out of mind, have been used for purposes of assembly, communicating thoughts between citizens, and discussing public questions. Such use of the streets and public places has, from ancient times, been a part of the privileges, immunities, rights and interests of citizens . . . . [i]t must not, in the guise of regulation be abridged or denied.
