If Romney wins, he locks in a conservative majority on the Supreme Court for decades. At that point, we may as well give up on getting the Supreme Court to decide that the Constitution, as it stands, guarantees the right to marriage equality. We'd be better off working on the monumental challenge of a marriage-equality amendment to the US Constitution.
If Obama wins, suddenly there's a good chance by 2016 for a majority of Supreme Court justices to be liberal, or at least moderate. Then we could have marriage equality justly recognized as a right already protected by the Constitution.
This election may well decide whether we have national marriage equality in 2015 or 2055. Let's get busy.
