What leaps out from Kenneth's comment is...he's spot on. It's emblematic of the entire conservative movement:
It works, so let's kill it.
Think of each and every thing that phrase would be applied to, if Republicans could make it so. Voting Rights? As of today, check. Civil Rights? Boom. The EPA? Blam. The Consumer Financial Protection Bureau? Youuuuu're outta there!
But why be coy? There's so many American laws and court rulings that worked! Gee, where to start? Brown versus Board of Education. Roe v. Wade. Medicare. Medicaid. Social Security.
Stop. Why are we wasting time on that bus league crap? Let's go to the majors!
The Twenty Sixth Amendment (franchise to 18 year olds and up guaranteed). How do young people vote again. Ah, yes. This is so gone.
The Nineteenth Amendment giving women the right to vote? Get thee behind me, Satan!
The Seventeenth Amendment enacting direct election of Senators? I wish this was snark but Republicans are already on it. Go, go, go.
The Fifteenth (discrimination on race, religion, etc.)? Why stop with the Voting Right Act? This is where it's headed.
The Fourteenth (delineating citizenship, due process, equal protection). See: Bush v Gore. War on Drugs.
Brace yourself... the Thirteenth (abolishes slavery). (Cube farm flashbacks. Last visit to Wal-Mart flashback.)
....
However... then come those things that I doubt very much the Roberts Court will overturn, on the grounds that it works so it's no longer necessary.
I'll just go with two of them
1. Marbury v Madison (judicial review)
2. The Second Amendment.
