Fact 1.

George Zimmerman claimed to be headed to Target to buy lunch for the next day.
Possible Cross Examination Questions

Who (in their right mind) needs to pack a pre-loaded, hot and ready gun with 1 in the chamber, plus a full 7 round magazine.....simply to go to go pick up lunchmeat?

Since when are concealed weapon's allowed in department stores such as Target?

Fact 2.

George Zimmerman stated in his walk-through interview with Detective Sereno that Trayvon was "looking around".

Did it not occur to Zimmerman that Trayvon may have been concerned for his own safety once he realized he was being followed by a "Creepy looking Cracka" in a pick up truck?

Rachel Jeantel testified that Trayvon Martin asked Zimmerman "Why are you following me" (Martin actually asked twice as chronicled 3/28/2013)

George Zimmerman had not one, but two flashlights.

How was it possible for Trayvon Martin to sneak up on him out of the Darkness?

Why did Zimmerman initially claim that Trayvon jumped out of the bushes, during his initial interview with police, but during the Walk-through the next day there were no bushes near the T section he claimed to be attacked at?

Fact 5

At the conclusion of the incident, it was determined that the larger of Zimmerman's two Flashlights was no longer operational.

If his flashlight was working when he first left his vehicle, at what point did it stop?

If his flashlight was not working before he left his car, why did he continue to carry a non-working Flashlight?

Could he have intended to use it as a Club?

Is it possible he used it to search for Trayvon,  and after he found him hiding in the bushes, it got broken during the struggle?

Zimmerman contradicts himself during his walk through interview with Detective Soreno when he states that after he got off the phone with Non-Emergency that he saw him (Trayvon)......he then stuttered and changed his story in mid sentence and stated, "as I was walking toward him"

The Defense for Zimmerman made a point to ask the Jurors why didn't Trayvon run home during the 4 minutes between the time Zimmermman hung up with Police Dispatch, and catching up with Zimmerman.

Over 45 minutes worth of Trayvon Martin's phone records were retrieved and put into evidence. However, Trayvon wasn't the person who was on Trial.

Why weren't George Zimmerman's phone records also put into evidence?

Is it possible that Zimmerman was called by a Resident who spotted Martin as he returned to the Community from the side entrance, and they Zimmerman to come to the location to shadow Martin's movements.

There were four different Surveillance Video operating at the Gated Community Clubhouse, which directly contradict George Zimmerman's claims of how and when he spotted Martin, however none of this  was put into evidence.

Is it possible it would have shown a time discrepancy in Zimmerman's Timeline?

The Defense attempted to use the Victim's own father Tracy Martin, initial reaction of not being able to recognize his son's voice screaming in agony.

Why did the Prosecution not use the audio of Zimmerman not recognizing his own voice during an interview with Detective Sereno actually trying to coach him into saying it was.

If Zimmerman was truly the only one yelling for help, why couldn't he recall himself doing so less than 24 hours later?

Zimmerman referenced 1460 Retreat View Circle as being the place where he first spotted Trayvon and that it also happened to be one of the homes that had been Burglarized in the past.

If Zimmermnan's pistol was holstered, behind his back and under his waistband, how was it possible for Trayvon to know Zimmerman had a gun in the first place?

How could Trayvon reach for a gun that was tucked inside the pants of a 200-lb. man lying on his back?

George Zimmerman had Photos taken of himself at the Police Station
Possible Cross Examination Questions

Why is it his nose looks broken and swollen in one photo taken by a cell phone  minutes after the incident (which had no chain of custody) but still allowed into evidence. However an hour later his nose seems perfectly fine, with the exception of a small scratch on the upper bridge of the nose, and no swelling at all?

Why is it Zimmermn's nose injury, as seen in the Police Department photo, seems more consistent with a Gun Recoil injury?

Why is it Zimmerman boots still have blades of wet grass on the upper portion of the tow guard, but the back of his jacket, the back of the boots, the seat of his pants, do not have any scuff marks, or grass stains?

After sustaining what Zimmerman wants everyone to believe was the a life and death struggle, should  there not be more damage to his clothing?

    Look, I get it—I'm not pleased with the verdict either.  But armchair quarterbacking by amateur lawyers isn't helpful.  Most of the things you're bringing up are evidentiary matters (that is, they're not admissible for one reason or another).  You didn't unearth some massive oversight by the prosecution.

      was part of the trial in one form of another. Either through evidence, or through George Zimmerman's own mouth via Video testimony.

      You claim to "get it", but I don't think you really do.

      Please re-read the title of my posting. I am highlighting 15 facts that the Prosecution failed to explore or cross-examine more thoroughly.

      This is not Monday morning Quarterbacking, these are the questions I was asking myself in real time as I watched the trial every day.

      As for being eveidentiay, how is it possible that Attorney West and O"mara can keep Rachel Jenteal on the stand for 5 hours and dwell on Trayvon's passive use of the "N" Word, and "Cracka", but the Prosecution couldn't spend an extra minute to exploring the fact the the Neighborhood Burglar had already been arrested and that there was no need to be so paranoid of every "Black person" that walked the street.

      Had the Prosecution been half as serious about getting a conviction on Zimmerman, the same way they did against Marrissa Alexander, they would have been more successful in not only disproving George Zimmerman's lies, but they would have been able to prove that Zimmerman left his home with a hunt in mind, and that the 4 minute gap in time that O'Mara claimed could have been enough for Trayvon to run home, was actually all the time Zimmermna needed to run to the south end of the complex using the street, and cut Trayvon Martin,  off from his home.

      Thus forcing Trayvon to turn around and start walking back towards the north end of the Dog Walk where Zimmerman finally confronted Trayvon at gunpoint.

      Zimmerman did all of this without acknowledging who he was at any time, leaving Trasyvon to believe he was being chased by either a pedophile, or a mexican Gang member.

      Zimmerman deliberately failed to identify himself knowing that Trayvon would eventually try to protect himself, the same way Zimmerman mistakenly attacked an undercover Police officer himself several years earlier.

      The only difference is that Zimmerman came out of his experience with a slap on the wrist, thanks to his Uncle on the Police Force and a Father who is a Judge. While Trayvon Martin came out of it with a bullet in his heart.

      or an audio-recording. The person they would have needed to cross-examine was Zimmerman himself, and he couldn't be compelled to testify (and wisely chose not to, precisely so he couldn't be cross-examined).

      There are many many grounds for criticizing how the prosecution handled this case, rulings they failed to object to, and a general either incompetence or half-hearted prosecution. I have already seen several good articles (by criminal lawyers who know this stuff much better than I do). But "failure to cross-examine" isn't a useful one to analyze.

    however, it is not surprising to me that TM's killer didn't recognize his own voice. Most everyone has difficulty recognizing their own voice on a recording.

    But one thing we should not forget: two outside voice experts, who were not allowed to testify, concluded that the screams were not from George Zimmerman. AFAIK, there has been no expert claiming that they did. I wonder if that those experts would be allowed to testify in a civil trial.

    Trayvon was also talking on the phone and could very well have been moving his upper body while he talked, like most folk do.

  •  How Did Anyone Draw the Gun (0+ / 0-)

    I keep wondering how either party would have been able to draw the gun with Zimmerman lying on the ground and Martin supposedly kneeling on his chest and pounding his head into the ground.  If Martin were kneeling on Zimmerman so his arms could reach Zimmerman's head, Martin's legs would have been up tight against the side of Zimmerman's body, making access to the gun very difficult if not impossible for either person.  Martin's apparent ready knowledge of the gun and Zimmerman's ability to use it easily would seem to imply that Zimmerman was holding the gun when he was confronted by Martin.  If anyone had fear for his life that night under those circumstances, it would seem to have been Martin.  It seems that it was easy to turn a somewhat weak case into a hopeless one with surprising facility.
