It has been a while since Mark Herring was declared the winner of the state AG race in VA by 165 votes out of 2.2 million cast. Under VA law a recount would be allowed and paid for by the state. Mark Obenshain exercised that right as many thought and would let things go quietly if he ended up on the loosing side, or so we thought. I apologize for the lack of information in this diary but I thought it was important to get this out to the dkos community.
In today's metro section of the Washington Post, the legal team for Obenshain is claiming "irregularities" on how ballots were handled in Fairfax County. Fairfax is the largest county in VA and helped to put Herring over the top. Some issues include gaps in when ballots were reported and the security of such ballots that were used in the voting and ballots that were blank. Although Obenshain had not made any comment on the matter from my interpretation of the article and quotes from the article, the reference to ballot irregularities is laying the ground work for taking this election to the General Assembly where it would go before both houses and then both houses would decide if they either want to change the result of the election or call a new election which had never been done in state history. The GOP as of now hold around a 86ish advantage in the General Assembly out of the 140 total seats in the House of Delegates and State Senate. Stay tuned! This could get interesting.
