I am turning my normal mystic's attention to divining the the ethos, the meta, of the way 5/9 of the Supreme Court makes decisions (and legislates from the bench). On thing that occurs to me is that the originalists - or fundamentalists if viewed through a religious template - exhibit a monomaniacal focus on individual rights without regard to the effects of those decisions on American society. Some of these individuals gathering these rights, in keeping with the clear but incomplete thinking in the Constitution, are corporations. And 5/9 of this Court are consistent and utterly predictable, and will reliably hobble America with Hobby Lobby cases for the foreseeable future.
Like theologians in their remote ivy towers, they live in a bubble of formulaic language, inscrutable founding texts, contradictory 'facts,' and....beliefs. They are as remote from the society and world around them - entering and leaving their bubble through a buffer zone, and getting their news from cable TV and acolytes (law clerks). With Congress having abdicated their check on the Court, to say nothing of decency in general, We the People are having our rights transferred to Them the Corporations. Thus feudalism, dead and gone in Europe, is being instituted on our shores....and at this prospect, originalists notwithstanding, the Founders must feel as if they have been sent to Hell.
Only Congress can save them. Which is to say, God save us all. Because this Congress won't.
