Kris Kobach, the worst secretary of state in the nation, was hoping to force Democrats to name a new candidate in the U.S. Senate race after the Kansas Supreme Court ordered Democrat Chad Taylor to stay off the ballot.
A Kansas City-area Democrat, whose son happens to be the regional field director for Governor Brownback's re-election campaign, filed a lawsuit trying to force Democrats to name a new candidate.
Today the court said they won't yet consider the case:
In today’s order, the Kansas Supreme Court sends the case to a lower court to take evidence, and consider various barriers to mandamus relief, including ripeness, standing, and other concerns.
The effect of this order is to delay things beyond the point at which it would make sense for Democrats to put a name on the ballot. That is, by the time the issue would get back to the Supreme Court, ballots may have been printed.
Democrats had been hoping to run out the clock in this case, and this is a big order helping that cause.
Once again, the court has come down on the side of voters and against the worst secretary of state in the nation.
