You may recall that back in August, a three judge panel of the Ninth Circuit dismissed NOM's request to intervene in Oregon's marriage case. Now, the Ninth Circuit has denied en banc review of that ruling.

In August, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit rejected the NOM’s attempt to appeal the May 19 ruling, upholding the District Court’s ruling that it lacked standing to intervene in the case.
In September, the NOM requested an en banc hearing, asking that an 11-judge panel of the Ninth Circuit reconsider its request.
On Monday, the court denied that request in a brief order stating, “No judge has requested a vote on whether to rehear the matter en banc.”
The frustration of the Ninth Circuit is palpable.
Their ruling also stated:
Appellant the National Organization for Marriage’s petition for rehearing en banc is denied.
As in, "now do you understand you f*cking lost?"
So, to recap: This is the sixth time that NOM has lost their effort to undo marriage in Oregon.
1. On May 14, at a hearing for their intervention request, Judge McShane denied their request to intervene.
2. About 30 seconds after that, he denied their request for a stay.
3. On May 19, the day of the ruling, the Ninth Circuit denied their request for a stay.
4. On June 4, the Supreme Court denied their request for a stay.
5. On August 28, the Ninth Circuit denied their request to intervene.
6. This.
